Adakah anda terkeliru dengan dua logo ini?

Ada satu laman web yang bernama PrePear berdepan masalah untuk daftarkan tanda dagang mereka sejak tahun 2017 kerana Apple mendakwa logo mereka sangat sama dengan logo Apple.

Sebelum itu, PrePear adalah sebuah laman web yang menghimpunkan resipi masakan dan juga menyediakan servis beli belah barang dapur.

Apple membentangkan dua hujah bagi menentang penggunaan logo PrePear iaitu:

  • Logo boleh menimbulkan kekeliruan, mengakibatkan kesilapan, ataupun digunakan untuk menipu
  • Pencairan terhadap tanda dagang yang sudah terkenal menyebabkan kerosakan imej pada logo Apple

Dalam hujah pertama, pihak Apple menguraikan yang logo pihak PrePear menggunakan rekaan minimalistik sebiji buah dengan sehelai daun menunjukkan kea rah kanan. Di pihak PrePear, mereka tidak katakana itu adalah imej buah pir, ia boleh jadi papan pemotong kerana rekaan minimalistiknya. Mungkin buah pir itu disimpulkan daripada nama syarikat PrePear.

Recently @apple yes, The trillion dollar Apple, has decided to oppose and go after our small business’ trademark saying our pear logo is too close to their apple logo and supposedly hurts their brand? This is a big blow to us at Prepear. To fight this it will cost tens of thousands of dollars. The CRAZY thing is that Apple has done this to dozens of other other small business fruit logo companies, and many have chosen to abandon their logo, or close doors. While the rest of the world is going out of their way to help small businesses during this pandemic, Apple has chosen to go after our small business. I’m not trying to get anyone to stop using or buying Apple products. I feel a moral obligation to take a stand against Apple's aggressive legal action against small businesses and fight for the right to keep our logo. We are defending ourselves against Apple not only to keep our logo, but to send a message to big tech companies that bullying small businesses has consequences. Pencairan tanda dagang yang digusarkan Apple adalah kerana logo ini sudahpun digunakan sejak 1976 dan ia sangat ikonik sehinggakan boleh mencacatkan imej Apple sekiranya produk atau servis yang ditawrakan PrePear tidak selari dengan visi Apple.

Benda ini bukanlah kali pertama. Apple permah menghalang dua lagi syarikat kerdil daripada memfailkan tanda dagang logo, satu di Norway dan satu lagi di Jerman.
